This document provides a comprehensive set of Terms and Conditions for Genx Shipping. It has been structured as a formal legal agreement, adhering to Jamaican commercial standards and the specific operational details you provided.

TERMS AND CONDITIONS OF SERVICE

These Terms and Conditions ("Agreement") govern the courier and logistics services provided by Genx Shipping ("the Company") to the customer ("the Client"). By utilizing the Company’s services, the Client agrees to be bound by the following terms.

1. SERVICE DESCRIPTION

1.1 Scope of Service: Genx Shipping provides international and domestic logistics solutions, including Air Freight, Sea Freight, and local ground transportation.

1.2 Specialized Services: The Company offers package pickup, personal delivery, and real-time tracking through its digital platforms.

2. CUSTOMER RESPONSIBILITIES

2.1 Accuracy of Information: The Client must provide accurate descriptions, values, and documentation for all items.

2.2 Packaging: It is the Client’s responsibility to ensure items are packed securely for international transit. The Company is not liable for damage resulting from inadequate packaging.

2.3 Prohibited Items: The Client agrees not to ship any items listed on the Jamaica Customs Agency (JCA) restricted or prohibited list, including but not limited to explosives, firearms, ammunition, or illicit drugs.

3. PRICING AND PAYMENT TERMS

3.1 Freight Charges: * Initial Pound: $650 JMD.

  • Subsequent Pounds: $600 JMD per lb.

    3.2 Processing Fees: A standard fee of $200 JMD applies per package.

    3.3 Local Delivery: Personal delivery within primary service areas is charged at a flat rate of $1,000 JMD.

    3.4 Payment Timing: All freight charges, duties, and fees must be paid in full prior to or at the time of package collection/delivery unless otherwise agreed in writing.

4. DELIVERY TERMS AND STORAGE

4.1 Timeframes: Standard delivery is 1–2 business days after the package status is updated to "Ready for Pickup/Delivery."

4.2 Operating Hours: * Monday – Friday: 8:00 AM – 5:00 PM

  • Saturday: 10:00 AM – 5:00 PM

  • Public Holidays: 10:00 AM – 2:00 PM

    4.3 Storage Fees: Packages held at any collection point for more than 14 calendar days will incur a storage fee of $150 JMD per day.

    4.4 Unclaimed Packages: Items left uncollected for more than 60 days may be auctioned or disposed of to recover freight and storage costs.

5. LIABILITY AND INSURANCE

5.1 Liability Limit: The Company’s liability for loss or damage is limited to the declared value of the item or a maximum of $100 USD (whichever is lower), unless additional insurance was purchased.

5.2 Exclusions: The Company is not liable for indirect or consequential losses, or damage to fragile items not properly crated.

5.3 Claims: All claims for damage or loss must be submitted in writing within 48 hours of receipt of the package.

6. FORCE MAJEURE

6.1 The Company shall not be held liable for delays or failures in performance resulting from circumstances beyond its control, including but not limited to:

  • Acts of God (hurricanes, earthquakes, floods).

  • Customs inspections or government-mandated delays.

  • Airline or shipping line cancellations.

7. PRIVACY AND DATA PROTECTION

7.1 The Company collects and stores Client data (Name, TRN, Contact details) solely for the purpose of clearing customs and facilitating delivery.

7.2 Client information will not be shared with third parties except as required by the Laws of Jamaica or for essential service execution.

8. DISPUTE RESOLUTION

8.1 Amicable Settlement: Any dispute arising from these terms shall first be addressed through internal mediation with Genx Shipping management.

8.2 Governing Law: This Agreement is governed by the laws of Jamaica. Any unresolved legal action shall be subject to the exclusive jurisdiction of the Jamaican courts.

9. MODIFICATION OF TERMS

9.1 Genx Shipping reserves the right to update these Terms and Conditions at any time. Clients will be notified of significant changes via the email address provided or via updates on our official website.

10. OPERATIONAL POLICIES

10.1 Package Inspection: The Company reserves the right, but is not obligated, to open and inspect any shipment for security, customs, or verification purposes without prior notice to the Client. 10.2 Weight & Measurement: All packages are weighed upon arrival at our Mandeville hub. If there is a discrepancy between the shipper's weight and the Company’s scale, the Company’s measurement shall prevail for billing. 10.3 Consolidation: Genx Shipping offers package consolidation upon request. A consolidation fee may apply, and the 1-2 day delivery timeframe begins only once the final package in the requested set has been processed. 10.4 Invoicing: Clients are required to upload invoices for all packages. Failure to provide a valid invoice may result in customs delays or estimated valuations by the Jamaica Customs Agency, for which the Company is not liable.

11. REFUND AND RETURNS POLICY

11.1 Service Refunds: Refunds for shipping markers (freight and processing) are only issued in cases of proven gross negligence or service failure on the part of Genx Shipping. No refunds are issued for delays caused by third-party carriers or customs. 11.2 Return to Vendor (RTV): If a Client wishes to return an item to an international seller (e.g., Amazon, eBay), the Client is responsible for all export shipping costs, duties, and administrative fees. Genx Shipping will facilitate the outbound logistics but does not guarantee the vendor's acceptance of the return. 11.3 Abandoned Packages: If a refund is requested for a lost item that has been compensated by insurance, the item becomes the property of Genx Shipping if it is subsequently recovered. 11.4 Payment Errors: Any overpayments made via bank transfer or digital platforms will be credited to the Client's Genx Shipping account for future use unless a manual wire refund is specifically requested (subject to bank processing fees).
